Title Examinations

Title Examinations are  close examinations of all public records that affect the title to the real estate you are purchasing. The search involves reviewing past deeds, wills, and trusts to make sure the title has passed correctly to each new owner.   Full Title Examinations usually cover all activity for a period of 40 years and include tracing a chain of title back in time, identifying all owners, reviewing deeds, judgments, deeds of trust and determining whether the title to the subject property is "clear" or "without cloud" - ultimately meaning that it is properly marketable.

Title Updates

Title Updates are undertaking a title exam for a shorter duration than  the full title's 40 year period.  In some cases, a title update may be done for a period of 20 years, while in others a short-duration title update may be required to ensure that no additional transactions have involved the property since a closing, prior to recording.

UCC Filing Searches

Uniform Commercial Code Filings (UCC) - A UCC-1 financing statement (an abbreviation for Uniform Commercial Code-1) is a legal form that a creditor files to give notice that it has or may have an interest in the personal property of a debtor (a person who owes a debt to the creditor as typically specified in the agreement creating the debt). This form is filed in order to "perfect" a creditor's security interest by giving public notice that there is a right to take possession of and sell certain assets for repayment of a specific debt with a certain priority. Such notices of sale are often found in the local newspapers. Once the form has been filed, the creditor establishes a relative priority with other creditors of the debtor.[1] This process is also called "perfecting the security interest" in the property, and this type of loan is a secured loan.[2] A financing statement may also be filed in the real estate records by a lessor of fixtures to establish the priority of the lessor's rights against a holder of a mortgage or other lien on the real property. The creditor's rights against the debtor and the lessor's rights against the lessee are based on the credit documents and the lease, respectively, and not the financing statement.


Pursuant to the standards set forth in the UCC, at 9-503 and 9-504, the financing statement need only contain three pieces of information:


1, the debtor's name and address

2. the creditor's name and address

3. an indication of the collateral, "whether or not it is specific, if it reasonably identifies what is described." (UCC 9-108).


UCC Filing research can be extremely time consuming, but is a necessary step in commercial transactions for protection of the buyer and lender.

Recordings

Recordings are required in the Commonwealth of Virginia to place the world on "Notice" of the ownership of real property.   The vast majority of states in the United States employ a system of recording legal instruments (otherwise known as deeds registration) that affect the title of real estate as the exclusive means for publicly documenting land titles and interests. This system differs significantly from land registration systems, such as the Torrens system that have been adopted in a few states. The principal difference is that the recording system does not determine who owns the title or interest involved, which is ultimately determined through litigation in the courts. The system provides a framework for determining who the law will protect in relation to those titles and interests when a dispute arises.  Pro-Title Can take care of recording your documents.
